       ORDINANCE NO. _____    

AN ORDINANCE DECLARING CERTAIN CITY
PROPERTY SURPLUS AND SUBJECT TO SALE

 

BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

     WHEREAS, it has been decided that certain property owned by the City of Thibodaux is no longer needed for public purposes (see description below); and

     WHEREAS, in accordance with the provisions of Title 33, Section 4712 of the Louisiana Revised Statutes (R.S.  33:4712), the City Council must adopt a ordinance declaring the said surplus property surplus and fixing the minimum price at and terms of the sale; and

     WHEREAS, the City may sell or dispose of this property to private persons at a private sale; and

     WHEREAS, this ordinance shall be published in accordance with the provisions of the aforementioned statutes in the local journal prior to the sale of the property; and

     WHEREAS, any opposition to this proposed ordinance shall be made in writing and filed with the Council Administrator of the City of Thibodaux within fifteen (15) days after the first publication of the following Notice of Proposed Ordinance:

 

NOTICE OF PROPOSED ORDINANCE

 

NOTICE IS HEREBY GIVEN that an Ordinance has been introduced and is proposed for adoption by the City Council of the City of Thibodaux whereby, the City would sell by private sale to Thibodaux Lumber and Concrete Co., Inc., for and in consideration the price and sum of Forty-Five Thousand, Four Hundred AND No/100 ($45,400.00) DOLLARS the following described property, to-wit:

 

A certain tract or parcel of land fronting Rue Loudon and measuring approximately ­­­­­25,933 square feet

 

Said tract of land being more particularly described on the map of survey prepared by David A. Waitz, Consulting Engineer, dated May 14, 2003 approved June 5, 2003.

 

This sale is made and accepted subject to the following terms and conditions:

property is sold “ as is”

property is sold without warranties, representations or guarantees, either express or implied

property is sold subject to restrictive covenants, easements, obligations of ownership, etc. affecting the described property of record in the Clerk of Court's Office in and for Lafourche Parish, Louisiana

purchaser shall erect a fence equipped with screening in the rear or to the East of the property purchased, such fence shall be at least six (6) feet in height

 

Any opposition to the proposed Ordinance shall be made in writing and filed with the Council Administrator within fifteen (15) days after the first publication of this Notice.

If an opposition is filed, the City of Thibodaux shall not adopt the Ordinance until a hearing has been held.

     WHEREAS, this ordinance shall not become effective until ten (10) days after its adoption provided no order filing objection to the sale is issued by a court of competent jurisdiction; and

     WHEREAS, any sale made relative to this matter shall be final and shall not include any warranties or any oil/mineral rights.

     NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux in regular session that the following City property be and is hereby declared surplus in accordance with the State Statutes referred to herein:

 

     PROPERTY DESCRIPTION                 MINIMUM  SALES  PRICE

    

     A certain tract or parcel of land              $45,400.00     

     fronting Rue Loudon and measuring

     Approximately 25,933 square feet

 

     BE IT FURTHER ORDAINED that the City Council of the City of Thibodaux does hereby authorize the Mayor to execute all necessary documents including an Act of Cash Sale for and on behalf of the City of Thibodaux.

   The above ordinance having been submitted to a vote, the vote thereon was as follows:
