            MAY 10, 2005
     

            

The City Council of the City of Thibodaux assembled in special session at its regular meeting place, City Hall, 310 West 2nd Street, Thibodaux, Louisiana, on Tuesday, May 10, 2005 at 5:00 o’clock P.M.

 

            There were present:  Councilmen Swanner, G. Richard, Winston, Mire and Dee Richard.

 

            There were also present:  Mayor Charles Caillouet and Germaine Jackson.

 

            A public hearing was held on an ordinance to amend the City of Thibodaux Zoning Ordinance to create a “TND” (Traditional Neighborhood Development) Zoning District.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to amend the proposed ordinance to make the ordinance effective immediately once signed by the Mayor.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

            ABSENT: None

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt an ordinance to amend Article V of the Thibodaux Zoning Ordinance to create the zoning designation of “TND District” and designate the district regulations thereof as amended.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

ORDINANCE NO.  2246

                                

                                    AN ORDINANCE TO AMEND ARTICLE V (SCHEDULE

OF DISTRICT REGULATIONS) OF THE ZONING

ORDINANCE TO CREATE THE ZONING DESIGNATION

OF “TND DISTRICT” AND DESIGNATE THE DISTRICT

REGULATIONS THEREFOR

 

        BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, in accordance with the provisions of Article V of the Thibodaux Zoning Ordinance, there is no single zoning district which can comprehensively accommodate the development of a “Traditional Neighborhood Development” (TND); and

 

     WHEREAS, in order to accommodate such a development for the actual uses of the aforesaid property, it has been requested that the City consider creating a TND zoning district within the provisions of the City’s Zoning Ordinance; and

 

     WHEREAS, a request for the said zoning amendment was duly referred to the Thibodaux Planning and Zoning Commission, which, after all legal requirements, including public hearings, has recommended favorable consideration of the request.

 

     NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux that Article V of the Thibodaux Zoning Ordinance is hereby amended and re-enacted so as to create a TND District (Traditional Neighborhood District” and designate a schedule of district regulations therefore.

 

     BE IT FURTHER ORDAINED that the provisions of this ordinance will become effective immediately upon the signature of the Mayor.

 

   BE IT FURTHER ORDAINED a copy of the district regulations for the TND District is attached hereto as Exhibit “A” and thereby made a part hereof.

 

     The above ordinance having been submitted to a vote, the vote thereon was as follows:

 

     YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

     NAYS: None

     ABSENT: None

     ABSTAINED: None

 

     And the above ordinance was declared adopted this 10th day of May 2005.

            The Mayor signed the approval of Ordinance No. 2246 at 5:08 PM during the May 10, 2005 special City Council meeting thereby making the zoning designation TND District effective as of that time.

 

            A public hearing was then held on an ordinance to extend the corporate limits of the City of Thibodaux to include a 115-acre tract of property bounded by Bowie Road, North Acadia Road and the Percy Brown Road that is owned by Acadia Agricultural Holdings, LLC (AAH).  This ordinance also authorizes the mayor to execute a Cooperative Endeavor Agreement with AAH stipulating the conditions that will be met as a result of the annexation.

 

            On motion of Councilman Gene Richard, seconded by Councilman Mire, the Council voted to amend the ordinance in order to change the dates in the Cooperative Endeavor Agreement Article 5, Section 5.3, Sub-section (F) (1) and (2) from December 31, 2005 to December 31, 2007.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

            ABSENT: None

 

            On motion of Councilman Swanner, seconded by Councilman Winston, the Council voted to adopt an ordinance to extend the corporate limits of the City of Thibodaux to include a certain portion of land adjacent thereto (Acadia Plantation) as amended.  Upon roll call the vote was as follows:

ORDINANCE NO.  2247

 

 

                   AN ORDINANCE TO EXTEND THE CORPORATE LIMITS

                   OF THE CITY OF THIBODAUX TO INCLUDE A CERTAIN

                   PORTION OF LAND ADJACENT THERETO

 

 

     BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, the City of Thibodaux, Louisiana has received a petition from the owners of a certain tract of land adjacent to the corporate limits of the City of Thibodaux, Parish of Lafourche, State of Louisiana, which said petition requests that certain land be incorporated within the City limits of the City of Thibodaux; and

 

     WHEREAS, said proposed annexation is conditioned upon the execution of a cooperative endeavor agreement between the City and the property owners; and 

    

     WHEREAS, notice by publication in the official journal of the City of Thibodaux has been given of the City's intention to extend its limits; and

 

     WHEREAS, more than ten days have elapsed since the date of the publication of the said notice.

 

     NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that the corporate limits of the City of Thibodaux be extended to include the following described property:

 

     A certain tract or parcel of ground situated on a portion of Acadia Plantation containing 115.097 acres or 5,013,640 sq. ft., located in Sections 34, 35, 36, 37, 38, 39 & 90, Township 15 South, Range 16 East, Lafourche Parish, Louisiana, being more particularly described as follows:

 

Commencing at the intersection of the westerly right of way line of Bowie Road and the northerly right of way line of North Acadia Road, said point being the "POINT OF BEGINNING" and labeled "P.O.B.,"

 

Then, continuing along the westerly right of way line of Bowie Road, North 25 degrees 11 minutes 14 seconds East a distance of 1,030.36 feet to a point;

Then, departing said right of way line, South 43 degrees 40 minutes 57 seconds East a distance of 610.08 feet to a point;

     BE IT FURTHER ORDAINED that the property annexed will be accepted into the corporate limits of the City with the zoning designation of a TND District as recommended by the Planning and Zoning Commission.

 

     BE IT FURTHER ORDAINED that the Mayor be and is hereby authorized to execute a cooperative endeavor agreement with Acadia Agricultural Holdings, L.L.C. stipulating the conditions of the annexation.

 

     BE IT FURTHER ORDIANED that a copy of said agreement is attached hereto as Exhibit “A” and thereby made a part hereof.

 

     BE IT FURTHER ORDAINED that the above said described annexed property is hereby designated to be included in Council District B until changed by a future reapportionment of Council districts as required by the U.S. Justice Department.

 

     BE IT FURTHER ORDAINED that the entire boundary of the City Of Thibodaux as herein changed shall henceforth be as follows:

       

Commencing at a point which is the intersection of the prolongation of the lower or easterly line of Audubon Avenue in the Acadia Subdivision and the ordinary low-water mark of Bayou Lafourche; thence along the right descending bank of Bayou Lafourche, with its meandering in an easterly direction to a point 1507.6 feet to a corner; thence South along the western boundary of the right-of-way of Bowie Road  to a point approximately 1159.57 feet from the centerline of the former Louisiana and Delta Railway; thence ;

            A public hearing was held on an ordinance to amend the City of Thibodaux Zoning Ordinance to create a “TND” (Traditional Neighborhood Development) Zoning District.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to amend the proposed ordinance to make the ordinance effective immediately once signed by the Mayor.  Upon roll call the vote was as follows:

OF DISTRICT REGULATIONS) OF THE ZONING

ORDINANCE TO CREATE THE ZONING DESIGNATION

OF “TND DISTRICT” AND DESIGNATE THE DISTRICT

REGULATIONS THEREFOR

 

        BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, in accordance with the provisions of Article V of the Thibodaux Zoning Ordinance, there is no single zoning district which can comprehensively accommodate the development of a “Traditional Neighborhood Development” (TND); and

 

     WHEREAS, in order to accommodate such a development for the actual uses of the aforesaid property, it has been requested that the City consider creating a TND zoning district within the provisions of the City’s Zoning Ordinance; and

 

     WHEREAS, a request for the said zoning amendment was duly referred to the Thibodaux Planning and Zoning Commission, which, after all legal requirements, including public hearings, has recommended favorable consideration of the request.

 

     NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux that Article V of the Thibodaux Zoning Ordinance is hereby amended and re-enacted so as to create a TND District (Traditional Neighborhood District” and designate a schedule of district regulations therefore.

 

     BE IT FURTHER ORDAINED that the provisions of this ordinance will become effective immediately upon the signature of the Mayor.

 

   BE IT FURTHER ORDAINED a copy of the district regulations for the TND District is attached hereto as Exhibit “A” and thereby made a part hereof.

            A public hearing was then held on an ordinance to extend the corporate limits of the City of Thibodaux to include a 115-acre tract of property bounded by Bowie Road, North Acadia Road and the Percy Brown Road that is owned by Acadia Agricultural Holdings, LLC (AAH).  This ordinance also authorizes the mayor to execute a Cooperative Endeavor Agreement with AAH stipulating the conditions that will be met as a result of the annexation.

 

            On motion of Councilman Gene Richard, seconded by Councilman Mire, the Council voted to amend the ordinance in order to change the dates in the Cooperative Endeavor Agreement Article 5, Section 5.3, Sub-section (F) (1) and (2) from December 31, 2005 to December 31, 2007.  Upon roll call the vote was as follows:

     WHEREAS, the City of Thibodaux, Louisiana has received a petition from the owners of a certain tract of land adjacent to the corporate limits of the City of Thibodaux, Parish of Lafourche, State of Louisiana, which said petition requests that certain land be incorporated within the City limits of the City of Thibodaux; and

 

     WHEREAS, said proposed annexation is conditioned upon the execution of a cooperative endeavor agreement between the City and the property owners; and 

    

     WHEREAS, notice by publication in the official journal of the City of Thibodaux has been given of the City's intention to extend its limits; and

 

     WHEREAS, more than ten days have elapsed since the date of the publication of the said notice.

     BE IT FURTHER ORDAINED that the above said described annexed property is hereby designated to be included in Council District B until changed by a future reapportionment of Council districts as required by the U.S. Justice Department.
