            FEBRUARY 1, 2005
     

 

 

            The City Council of the City of Thibodaux assembled in regular session at its regular meeting place, City Hall, 310 West 2nd Street, Thibodaux, Louisiana, on Tuesday, February 1, 2005 at 5:00 o’clock P.M.

 

            There were present:  Councilmen Swanner, Winston, Mire and Dee Richard.

 

            Councilman Gene Richard was absent.

 

There were also present:  Mayor Charles Caillouet and Germaine Jackson.

 

            The minutes of the January 18, 2005 Council meeting were approved as written.

           

            Councilman Mire introduced an ordinance to amend and re-enact Article 7, Section 701.2 of the Thibodaux Zoning Ordinance so as to eliminate the last sentence of Section 701.2 in order to clarify the intent of the Section.  The public hearing on this ordinance will be held at the February 15, 2005 City Council meeting.

 

            A special election was held for the voters to consider the proposition calling for the re-dedication of City sales tax revenues.  The election was held Saturday, January 15, 2005.  The proposition for the re-dedication was approved by a vote of 175 FOR and 159 AGAINST.

 

            In conjunction with all applicable election laws it is required that the City Council canvass the returns and declare the results of the election.  This can be accomplished by means of the adoption of an appropriate resolution.  It is also required that the City create a process verbal of the returns by voting precinct and absentee votes.

 

            On motion of Councilman Mire, seconded by Councilman Winston, the Council voted to adopt a resolution declaring the results of the January 15, 2005 election and canvassing the returns thereof.  Upon roll call the vote was as follows:

           

            YEAS: Councilmen Swanner, Winston, Mire and D. Richard

            NAYS: None

            ABSENT: Councilman G. Richard

 

                       

The following resolution was offered by Councilman Mire and seconded by Councilman Winston:

                                                         RESOLUTION NO. 1099

A resolution providing for canvassing the returns and declaring the result of the special election held in the City of Thibodaux, State of Louisiana, on Saturday, January 15, 2005, to authorize the levy of a sales and use tax therein.

                        BE IT RESOLVED by the City Council of the City of Thibodaux, State of Louisiana (the "Governing Authority"), acting as the governing authority of the City of Thibodaux, State of Louisiana (the "City"), that:

 

                        SECTION 1.  Canvass.  This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the City of Thibodaux, State of Louisiana, (the "City"), on SATURDAY, JANUARY 15, 2005, to authorize the levy of a sales and use tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.

 

                        SECTION 2.  Procès Verbal.  A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Lafourche, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

 

                        SECTION 3.  Promulgation of Election Result.  The result of said election shall be promulgated by publication in the manner provided by law.

 

                        This resolution having been submitted to a vote, the vote thereon was as follows:

 

                        YEAS: Councilmen Swanner, Winston, Mire and D. Richard

                        NAYS: None

                        ABSENT:   Councilman G. Richard

            BE IT KNOWN AND REMEMBERED that on Tuesday, February 1, 2005, at five o'clock (5:00) p.m., at its regular meeting place, the City Hall, Council Chambers, 310 West Second Street, Thibodaux, LA  70301, Thibodaux, Louisiana, the City Council of the City of Thibodaux, State of Louisiana (the "Governing Authority"), acting as the governing authority of the City of Thibodaux, State of Louisiana (the "City"), and being the authority ordering the special election held therein on Saturday, January 15, 2005, with the following members present:

 

            Councilmen Swanner, Winston, Mire and D. Richard                           

 

            There being absent:  Councilman G. Richard

 

did, in open and public session, examine the official certified tabulations of votes cast at the said election, and did examine and canvass the returns of the said election, there having been submitted at said election the following proposition, to wit:

 

                                   1967 SALES TAX REDEDICATION PROPOSITION

 

SUMMARY: AUTHORITY TO REDEDICATE THE 1% SALES AND USE TAX PREVIOUSLY AUTHORIZED BY AN ELECTION HELD ON MAY 2, 1967, TO INCREASE THE MAXIMUM PERCENTAGE OF REVENUES THAT MAY BE APPROPRIATED TO THE GENERAL FUND AFTER MAKING ALL REQUIRED BOND PAYMENTS.

 

Shall the City of Thibodaux, State of Louisiana, having been previously authorized at an election held on May 2, 1967, to levy a one percent (1%) sales and use tax (the “Tax”), after providing for (i) principal, interest and reserve requirements in connection with the issuance and payment of all sales and use tax bonds of the City heretofore or hereafter sold and issued by said City or (ii) bonds issued in accordance with law to refund such bonds, secured by and payable from the avails or proceeds of said Tax, then shall said City be authorized to appropriate, dedicate and use 100% of the remaining revenues derived from the Tax and any unspent revenue heretofore received for the purpose of supplementing the general fund revenues of the City and for the capital improvements purposes set forth in the May 2, 1967 proposition approving the levy of the Tax?

 

            There was found by said count and canvass that the following votes had been cast at the said special election IN FAVOR OF and AGAINST, respectively, the proposition as hereinabove set forth at the following polling places, to-wit:

            The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there was a total of 175 votes cast IN FAVOR OF the Proposition and a total of 159 votes cast AGAINST the Proposition, as hereinabove set forth, and that there was a majority of 16 votes cast FOR the Proposition as hereinabove set forth.

 

            Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that the Proposition as hereinabove set forth was duly CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in the City on Saturday, January 15, 2005.

            A presentation by the Public Works Director was tabled until the February 15, 2005 City Council meeting.

 

            At the January 4, 2005 City Council meeting, the Council requested that the Mayor invite our State legislative delegation to attend a City Council meeting in order to discuss the creation of a couplet system in the City of Thibodaux along LA and LA 308 as approved by the State Department of Transportation and Development.

 

            Representative Warren Triche, Senator Joel Chiasson and Janice Williams with DOTD were present at the City Council meeting to discuss the project and to answer any questions that the Council or Administration may have concerning the couplet system in Thibodaux.

 

            There being no further business the meeting was adjourned.
